1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and PSYCHE VIBES ("Company," "we," "our," or "us") concerning your access to and use of PsycheSocial and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

3. AI-Generated Content and User Responsibility

3.1 Content Generation

The Service uses artificial intelligence and machine learning technologies to generate content based on your inputs. While we implement guardrails and content moderation systems, AI-generated content may occasionally produce unexpected, inaccurate, or inappropriate results.

3.2 User Liability for AI-Generated Content

IMPORTANT: You are solely and exclusively responsible for all content generated through the Service, including but not limited to images, text, captions, and any other AI-generated materials. By using the Service, you acknowledge and agree that:

• You assume full legal responsibility for all AI-generated content you create, publish, or distribute
• You will review all AI-generated content before publication to ensure it complies with applicable laws and regulations
• You are responsible for ensuring AI-generated content does not infringe on third-party intellectual property rights, privacy rights, or other legal rights
• You will not use AI-generated content for illegal, harmful, defamatory, or fraudulent purposes
• The Company is not liable for any claims, damages, losses, or legal consequences arising from your use of AI-generated content

3.3 Content Guardrails

We implement technical and policy-based guardrails to prevent generation of harmful content, including:

• Prohibited content filters (illegal content, hate speech, explicit violence)
• Age verification for NSFW content generation
• Automated content moderation systems
• User reporting mechanisms

However, these guardrails are not foolproof. You acknowledge that no automated system can guarantee 100% accuracy, and you remain responsible for all content you generate and publish.

3.4 Indemnification for AI Content

You agree to indemnify, defend, and hold harmless PSYCHE VIBES, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of AI-generated content
• Publication or distribution of AI-generated content
• Third-party claims related to AI-generated content you created
• Violation of laws or regulations through AI-generated content

4. Account Registration and Security

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

You must be at least 18 years old to create an account and use the Service.

5. Subscription and Payment

5.1 Subscription Plans

The Service is offered through various subscription plans with different features and pricing. By subscribing, you agree to pay the applicable fees for your chosen plan.

5.2 Billing

• Payment will be charged to your payment method on the renewal date

5.3 Free Trials

We may offer free trial periods for new users. At the end of the trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

5.4 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will retain access to paid features until the end of the billing period.

6. Acceptable Use Policy

You agree not to use the Service to:

• Generate content that violates laws or regulations
• Create deepfakes or impersonate real individuals without consent
• Generate content depicting minors in any context
• Create content promoting violence, hate speech, or discrimination
• Infringe on intellectual property rights of others
• Engage in fraud, scams, or deceptive practices
• Distribute malware or engage in hacking activities
• Scrape, data mine, or reverse engineer the Service
• Resell or redistribute the Service without authorization
• Overload or interfere with Service infrastructure

7. Intellectual Property Rights

7.1 Service Ownership

The Service, including its software, design, features, and content (excluding user-generated content), is owned by PSYCHE VIBES and protected by copyright, trademark, and other intellectual property laws.

7.2 User-Generated Content

You retain ownership of content you create using the Service. By using the Service, you grant us a limited, non-exclusive, royalty-free license to:

• Store and process your content to provide the Service
• Use anonymized, aggregated data to improve AI models and Service features
• Display your content as examples in marketing materials (with your explicit consent)

7.3 AI Model Training

We may use anonymized, aggregated usage data and content to train and improve our AI models. Individual user content will not be used for training without explicit consent.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Accuracy, reliability, or completeness of AI-generated content
• Uninterrupted, secure, or error-free operation of the Service
• Results obtained from using the Service

We do not warrant that AI-generated content will be accurate, appropriate, or free from errors. You use the Service at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PSYCHE VIBES UK SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from use of AI-generated content
• Third-party claims related to content you generate or publish
• Service interruptions, errors, or security breaches

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of fees
• Any reason at our sole discretion

Upon termination, your right to use the Service will immediately cease. We may delete your account and content, though we may retain certain information as required by law or for legitimate business purposes.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or the Service shall be resolved through:

• Good faith negotiation between the parties
• Binding arbitration if negotiation fails
• Courts of England and Wales for matters not subject to arbitration

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
